Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and OUCH MATCH, LLC ("OUCH MATCH," "we," "our," or "us"), a Florida Limited Liability Company, governing your access to and use of our website at www.ouchmatch.com and our mobile application www.app.ouchmatch.com (collectively, the "Platform").

By accessing or using the Platform in any way — including browsing the website, downloading the app, or creating an account — you agree to be bound by these Terms. If you do not agree, you must immediately stop using the Platform.

These Terms apply to all users of the Platform, including visitors, registered users, and subscribers.

Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by one or more of the following methods:

Posting a notice on the homepage of the Platform
Sending an email to the address associated with your account
Displaying a notification when you log into your account

Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. You are responsible for reviewing these Terms periodically. We will make commercially reasonable efforts to notify you of material changes, but we are not obligated to do so for minor updates.

OUCH MATCH IS NOT A MEDICAL PROVIDER. The Platform does not provide medical advice, professional diagnosis, opinion, treatment, or services to you or any other individual. All content on the Platform including AI-generated insights is provided for informational and motivational purposes only. It is not a substitute for professional medical advice or a consultation with a qualified healthcare professional.

If you believe you have a medical emergency, call your doctor or 911 immediately. Never disregard professional medical advice or delay seeking it because of something you have read on OUCH MATCH.

OUCH MATCH does not recommend or endorse any specific tests, physicians, products, procedures, or opinions mentioned on the Platform. Reliance on any information provided by the Platform or its users is solely at your own risk.

Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are a parent or guardian and believe your child under 13 has created an account, please contact us at info@ouchmatch.com immediately.

Account Registration and Security

To access certain features of the Platform, you may be required to register for an account. You agree to:

Provide accurate, current, and complete information during registration
Keep your account credentials confidential and not share them with any third party
Notify us immediately of any unauthorized access to or use of your account
Ensure that all persons who access the Platform through your account comply with these Terms
Sign out of your account at the end of each session, especially on shared devices

We reserve the right to disable or terminate any account at any time, at our sole discretion, including if we believe you have violated these Terms.

The Platform — Website and App

OUCH MATCH operates both a website (www.ouchmatch.com) and a mobile application (www.app.ouchmatch.com). These Terms apply equally to your use of both. Features available may differ between the website and the app, but all use is subject to these Terms.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice and without liability to you.

AI Coach Feature

The Platform includes an optional AI Coach feature designed to provide personalized recovery tips and support. Please read the following carefully before using this feature:

Opt-In Required

The AI Coach is disabled by default. You must actively opt in and provide explicit consent before the feature is enabled. When you first access it, you will be shown a clear disclosure describing how your data will be used.

How It Works:

When you use the AI Coach, your text inputs are securely routed through Base44’s internal AI service and may be processed by third‑party AI providers, including OpenAI (GPT models) and Google (Gemini models). These providers use your inputs solely to generate a response within the app. Where possible, we configure our AI providers to limit the use of your data for model training.

No Medical Advice

AI-generated responses are based on patterns in data and are provided for informational purposes only. They do not constitute medical advice and must not replace consultation with a qualified healthcare professional.

Your Controls

Disable the AI Coach at any time via Settings > Privacy > AI Preferences
Delete your conversation history at any time in the same location
Opt out of AI model training via settings or by emailing info@ouchmatch.com

Subscriptions

Certain features of the Platform may be available through a paid subscription. Subscription billing is managed through third-party services including Stripe, Apple In-App Purchase, or Google Play Billing. By subscribing, you agree to the billing terms presented at the time of purchase. You may cancel your subscription at any time through your account settings or the relevant app store.

Permitted and Prohibited Uses

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform in any way that:

Violates any applicable local, state, national, or international law or regulation
Impersonates any person or entity, or falsely represents your affiliation with any person or entity
Transmits any unsolicited or unauthorized advertising, spam, or promotional material
Transmits harmful, disabling, or malicious computer code, viruses, or similar content
Harvests email addresses or other personal information from the Platform
Interferes with or disrupts the integrity or performance of the Platform or its underlying infrastructure
Attempts to gain unauthorized access to any part of the Platform or its related systems
Transmits content that is violent, obscene, sexually explicit, discriminatory, hateful, threatening, abusive, defamatory, or harassing
Suggests an express or implied affiliation or relationship with OUCH MATCH without our written permission
Modifies, alters, or creates derivative works from Platform content without authorization
Dilutes or depreciates the name and reputation of OUCH MATCH or its affiliates
Uploads content that infringes upon any third party's intellectual property or right to privacy

User-Generated Content

The Platform allows users to submit content such as blog comments and feedback. By submitting content, you agree to the following:

Your Responsibility

You are solely responsible for any content you post. You represent and warrant that you own or have the necessary rights to submit your content, and that it does not violate any law or third-party rights.

Prohibited Content

You must not post content that:

Promotes hate speech, racism, discrimination, or violence
Harasses, threatens, or bullies other users
Contains illegal content or promotes illegal activities
Is defamatory, libelous, or invasive of another's privacy
Contains obscene or sexually explicit material
Infringes any intellectual property rights
Contains spam, unsolicited advertisements, or malicious code

License to Your Content

By submitting content to the Platform, you grant OUCH MATCH a perpetual, royalty-free, worldwide, irrevocable, non-exclusive, freely sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purposes of operating and improving the Platform.

Public Visibility

Blog comments and other publicly submitted content may be visible to other users and indexed by search engines. Do not share personal, sensitive, or health-related information in public areas of the Platform.

No Endorsement

OUCH MATCH does not endorse any user-generated content. The views expressed by users do not necessarily reflect the views of OUCH MATCH.

Moderation

We reserve the right, but are not obligated, to monitor, review, edit, or remove any content at our sole discretion. We may suspend or terminate your access to the Platform for violations of these guidelines.

Intellectual Property.

All content on the Platform — including text, graphics, logos, images, audio, video, software, digital products, and their arrangement (collectively, "OUCH MATCH Content”) is the property of OUCH MATCH, LLC or its licensors and is protected by copyright, trademark, and other applicable laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform and its content for your personal, non-commercial use only. You may not modify, reproduce, distribute, create derivative works from, or exploit any OUCH MATCH Content without our express written consent.

All rights not expressly granted are reserved. Breach of this section will automatically terminate your license to use the Platform.

Electronic Communications

By using the Platform, you consent to receiving electronic communications from us, including service updates, transactional messages, and account-related notices. You agree that all electronic communications we send satisfy any legal requirement that such communications be in writing.

Third-Party Links and Platforms

The Platform may contain links to third-party websites or services that are not owned or controlled by OUCH MATCH. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. This Privacy Policy and these Terms apply solely to information collected through our Platform.

If you leave a review, rating, or comment on third-party platforms such as the Apple App Store or Google Play, that content is subject to the policies of those platforms. We do not control how third-party platforms collect or use your information.

Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at www.ouchmatch.com to understand how we collect, use, and protect your information.

By using the Platform, you consent to the data practices described in the Privacy Policy. We do not use health-related or recovery data for advertising or marketing purposes.

Disclaimers and Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

OUCH MATCH does not warrant that:

The Platform will be uninterrupted, error-free, or free of viruses or harmful components
Any content or information on the Platform is accurate, complete, reliable, or timely
The results of using the Platform will meet your expectations

Your use of the Platform and reliance on any content is entirely at your own risk

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUCH MATCH, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify, defend, and hold harmless OUCH MATCH, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Platform
Your violation of these Terms
Your violation of any rights of a third party
Any content you submit to the Platform

Accessibility

OUCH MATCH is committed to making the Platform accessible to all users, including those with disabilities. We strive to comply with relevant accessibility standards, including the Web Content Accessibility Guidelines (WCAG). Dispute Resolution

Informal Resolution

We encourage you to contact us first at info@ouchmatch.com to resolve any dispute informally before pursuing formal proceedings.

Binding Arbitration

If a dispute cannot be resolved informally, it will be submitted to binding arbitration conducted in accordance with the rules of the American Arbitration Association (AAA). The arbitrator's decision will be final and binding on all parties.

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in Florida, and you consent to the personal jurisdiction of such courts.

Statute of Limitations

Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Platform must be filed within one (1) year of when it arose, or it will be permanently barred.

International Users.

This Platform is operated in accordance with the laws of the United States. If you are accessing the Platform from outside the United States, you do so at your own initiative and are responsible for compliance with your local laws. By using the Platform and submitting personal information, you acknowledge that your data may be transferred to and processed in the United States in accordance with our Privacy Policy.

Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will continue to apply.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OUCH MATCH with respect to your use of the Platform and supersede all prior agreements and understandings.
